Pop of Colour Random Draw Official Rules

1. Introduction (when does this Promotion run from?)
These official rules(the “Official Rules”) apply to the ‘Pop Of Colour Random Draw’ (“Promotion”) running from Saturday 8th February 2025 12:00pm GMT to Thursday 6th March 2025 23:59pm GMT (the “Promotion Period”).
2. Who is the Promoter?
Oner Active UK Limited a company registered in England and Wales with company number 131889442, whose registered office is at 230 City Road, London, EC1V 2QY United Kingdom (the “Promoter”) is the sponsor of the Promotion.
3. What is the prize available to be win in the Promotion?
3.1 A OA gift voucher of £500 / $500 (“the Prize”).
3.2 Terms and conditions apply to use of gift voucher.
3.3 Prizes are awarded “as is” with no warranty or guarantee, either express or implied.
3.4 U.S. winner is will be responsible for all federal, state and local taxes and fees and other costs and expenses associated with prize receipt and/or use that are not expressly included in the prize description.
3.5 No cash or other substitution, assignment or transfer of the prize permitted, except by Promoter, who reserves the right to substitute prize or prize component with cash or another prize of comparable or greater value.
3.6 All prize details are at Promoter’s discretion.
4. How many Prizes are available?
4.1. Two (2) winners will be picked at random: UK (1 winner) and in California (1 winner).
5. How do I participate in the Promotion?
5.1. To participate in the Promotion, participants must complete and submit the entry form via Meta Pop of Colour lead form ad during the Promotion Period.
5.2. Limit one (1) entry per person. Multiple entries from any person will be void.
5.3. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Promoter and will not be acknowledged or returned.
5.4. By participating in the Promotion, all participants will be deemed to have read, accepted and be bound by these Official Rules and any other requirements set out in the promotional material for the Promotion (in the event of a conflict, the requirements set out in the promotional material will take precedence), as well as all applicable laws and regulations, including without limitation those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

6. Who is eligible to participate?
6.1. The Promotion is only available to legal residents of the UK and California aged 18 years or over. The Promotion is void where prohibited.
6.2. Sorry, you are not eligible to participate in the Promotion if you are:
(a) employees of the Promoter and its associated companies or group companies;
(b) anyone professionally associated with the Promotion; or
(c) members of the immediate families (spouse, and parent, child, siblings and their respective households, regardless of where they reside) or households, whether or not related, of (a) and (b) above.
6.3. The Promoter reserves the right at its sole discretion to disqualify from further participation in the Promotion any individual it has reason to believe is tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of these Official Rules, relevant laws and/or regulations and/or third party rights.
7. How are winners selected?
7.1 Entries will be divided into two (2) pools – one for UK entries and one for California entries.
7.2 Potential winners will be selected at random on or about 10 March 2025 from among all eligible entries received for the applicable drawing.
7.3 Odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.
7.4 Nonwinning entries from one drawing will not be included in the other drawing.
8. How will I know if I’ve won?
8.1 Promoter’s customer services team will send an email to the winner’s email address provided as part of their entry on Monday 10th March 2025.
8.2 Potential winners must comply with all terms and conditions of these Official Rules, and winning a prize is contingent upon fulfilling all requirements.
8.3 If a prize notification is returned as undelivered, a potential winner cannot be contacted or does not respond to the prize notification within the time period specified or is not in compliance with these Official Rules, such potential winner may be disqualified and forfeits the prize. If a potential winner is disqualified for any reason, Promoter may award the prize to an alternate potential winner by random drawing from among all remaining eligible entries received for the applicable drawing.
8.4 Following completion of the verification process, Prize will be sent to the winner via email.
8.5 The Promoter must either publish or make available information that shows that prizes were validly awarded. To comply with this obligation the Promoter will inform you of the surname and county of prize winners if you email [info@oneractive.com] no later than 30 days after the end of the Promotion.
8.6 If you object to any or all of your surname, county and winning entry made available, please contact the Promoter at https://uk.oneractive.com/pages/contact. In such circumstances, the Promoter must still provide the information and winning entry to the UK Advertising Standards Authority on request.
9. Limitation of Liability
9.1. By entering the Promotion, except with respect to Section 9.7 below, each entrant agrees to release and hold harmless Promoter, Meta Platforms, and their respective parents, affiliates, subsidiaries, officers, directors, shareholders, agents, employees and all others associated with the development and execution of this Sweepstakes (collectively, “Released Parties”) from and against any losses, damages, rights, claims or causes of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Promotion or resulting directly or indirectly, from acceptance, possession, use, or misuse of the prize awarded in connection with the Promotion.
9.2 Except with respect to Section 9.7 below, Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, emails, or other communications of any kind, or for postage-due, damaged or illegible mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitations, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prizes, or in any Promotion-related materials. 9.3 Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion.
9.4 Except with respect to Section 9.7 below, Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the site.
9.5 Released Parties are not responsible for any damage or loss suffered by any participant where such damage or loss was not, at the time the entry into the Promotion was made, a reasonably foreseeable consequence of a breach of these Official Rules, or where the Promotion does not run as planned.
9.6. The Released Parties will not be held responsible for the failure to fulfil the obligations of third parties involved in this Promotion, although the Promoter will always endeavour to minimise the effect to the participants of any such failure.
9.7. Nothing in these Terms shall operate to exclude the Promoter’s liability:
(a) for death or personal injury as a result of its negligence;
(b) for fraud; or
(c) further than is permitted by law.

11. General
11.1. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so without prior notice. In such event, Promoter reserves the right to award the Prizes at random from among all non-suspect, eligible entries received for each drawing up to the time of the impairment or as otherwise deemed fair and appropriate by Promoter.
11.3. The Promoter reserves the right to cancel or amend these Official Rules at any time without prior notice.
11.4 The Promotion is not sponsored, endorsed or administered by Meta Platforms.
11.3. These Official Rules and participation in the Promotion shall be governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
